Rules and Regulations of the Mydream.pl online store
§1 General provisions
- These Rules and Regulations specify the conditions of using of the online store registered under
the electronic address www.mydream.pl - The legal basis of these Rules and Regulations is in particular:
1) Act of 18 July 2002 on providing services by electronic means (Dz.U. [Journal of Laws] from 2016
item 1030)
2) Act of 30 may 2014 on consumer rights (Dz.U. [Journal of Laws] from 2014 item 827)
3) Civil Code Act of 23 April 1964 (Dz.U. [Journal of Laws] from 2016 item 380),
4) Act of 29 August 1997 on personal data protection (Dz.U. [Journal of Laws] from 2016 item 922).
The terms used in these Rules and Regulations are defined by the means of the following definitions:
1.Store – an online store located under the electronic address www.mydream.pl through which the
Seller sells the Goods without simultaneous presence of the parties using an ICT network.
2.Seller – Mydream.pl is run by Mydream- Michał Ibrom with its
registered office at Banino 80-297, 5/2 Miła Street entered into the register of companies under
REGON: 241780008, NIP: 6482447144, hereinafter referred to as Mydream or also Administrator of
data that owns the Store;
3.Buyer- a natural person with legal capacity (including Consumer), legal or organizational entity with
legal capacity, who makes a purchase in the Store;
4.Consumer – a natural person making purchases at the Store unrelated directly to its economic and
professional activities;
5.Goods – movable items offered by the Seller at the Store;
6.Order – a procedure leading to the conclusion of a sales Agreement using the Shopping Cart,
preceded by the selection of the parameters of the Goods, the payment and shipping method;
7.Agreement – a contract for the sale of Goods, which is concluded between the Seller and the Buyer
once the Order is accepted for realization;
8.Shopping Cart – an electronic form through which the Buyer makes the Order;
9.Registration – an action required to provide the Buyer Data necessary to create an individual Account
10.Data – the Buyer’s data, including personal data processed for the Order realization;
11.Account – an individual Buyer’s account created after Registration that allows placing Orders without
the need for data submission after every Order and makes the use of other Store functionalities
possible;
12.Price – the unit price of the Goods included in the description of the Goods, expressed in Polish
zlotys and containing VAT on goods and services; Price does not include Shipping;
13.Shipping – the costs of delivery of the Goods covered by the Buyer;
14.Payment – payment of fees for the Order placed, including the Price and Shipping, as selected by
the Buyer during the Ordering;
1.Use of the Store is by the means of an ICT system. For this purpose it is necessary to have a device
with Internet access and a web browser.
2.Before Registering or placing an Order, the Buyer is obliged to read the contents of these Rules and
Regulations and also the document defining the principles of personal data processing -Privacy Policy
and accept them.
3.The content of the Store website constitutes the property of the Seller and is legally protected.
4.The Buyer acknowledges that contact with the Seller regarding the realization of Orders and the
provision of the Services takes place by:

§2 Orders
Orders can be placed:
1.through the Store website www.mydream.pl
2.via email – mydream@mydream.pl or by phone number – 535 563 530 for all Goods currently available
in the online Store www.mydream.pl
3.Orders in the online Store and via email can be placed 24 hours a day, 7 days a week.
4.Phone Orders can be made Monday through Friday, from 9 am to 5 pm, excluding public holidays.
5.The Buyer may make changes to the Order or cancel the Order no later than the day preceding the
day of the Shipping, until midnight.
6.All Goods offered by the Seller in the Store are new and free from legal defects. The price shown in
the description of the Goods at the time of placing the Order is binding for the Buyer and the Seller.
7.The order is delivered after the payment has been made by the Buyer. This does not apply to the
Orders placed by Buyers with the cash on delivery option.
8.An e-mail confirming the acceptance of the Order is sent to the e-mail address indicated by the Buyer
when submitting the Order. It also contains the expected Order lead time, as well as links enabling the
Buyer to save the following data on an external drive:

3.a template of declaration of withdrawal from the Agreement – Attachment No. 2 to these Rules and
Regulations.
4.a template of the complaint form – Attachment No. 3 to these Rules and Regulations.
§3 Payment Methods
1.The Seller accepts the following methods of payment:
1.prepayment – an ordinary bank transfer
2.e-bank transfer through PayPal
1.In the case of selecting the electronic payment indicated in §3 paragraph1 point 1, the payment must
be made to the account:

1.In the case of selecting the electronic payments indicated in §3 paragraph 1 points 1-3, the day of
Payment is the day the Payment is registered on the Seller’s bank account.
§4 Shipping
1.Orders paid in advance by an ordinary bank transfer or by using PayPal are shipped up to 3 days
after the payment has been received.
2.The Goods are delivered by a courier service.
3.Approximate delivery time (by the courier service) is 2 working days from the dispatch date.
4.The Seller includes a receipt or at the Buyer’s demand an invoice.
5.In case of damage, incompleteness or other defects of the Goods, the Buyer is entitled to file a
complaint in accordance with the provisions of §7 of these Rules and Regulations.
6.The Buyer also has the right to withdraw from the contract and return the Goods and exchange it
under the terms specified in these Rules and Regulations.
§5 Returns – withdrawal from the Agreement
1.The Seller provides the Buyer with the possibility to withdraw from the Agreement concluded remotely
and return the purchased goods without giving a reason within 14 (fourteen) days after receiving the
shipment, in accordance with the Consumer Rights Act of 30 May 2014 (Dz. U. [Journal of Laws] from
2014 item 827).
2.In order to make a return, the Buyer may use the template of the withdrawal form attached as
Attachment No. 2 to these Rules and Regulations. The template of the withdrawal form is sent to the
Buyer’s e-mail address provided when placing the Order as specified in §2 paragraph 8
3.To maintain the time limit it is sufficient to send the declaration of withdrawal before the expiration of
the time limit.
4.In the case of withdrawal from the sales Agreement concluded remotely, the agreement is considered
as not concluded and the Buyer is exempt from any obligations. What the parties have rendered is
subject to be returned in an unchanged state, unless this change was made within ordinary use.
5.The consumer is obliged to return the item to the Seller immediately after withdrawal, but no later than
14 days after the date of withdrawal.
6.Shipping costs are covered by the Buyer.
7.The consumer acknowledges that he or she bears the responsibility for the reduction of the value of
the item being used in a way that goes beyond what is necessary to establish the character, features
and function of the item in accordance with the provisions of the Consumer Rights Act.
8.The Seller shall immediately, not later than within 7 days from the date of reception of the declaration
referred to in paragraph 3 above, return the payment made by the Consumer.
9.The Seller completes the refund using the same payment method as used by the Consumer, unless
the Consumer agrees otherwise, without incurring any costs by the Consumer.
10.The Buyer may agree to the refund referred to in paragraph 7 to the bank account indicated by him
in the withdrawal form.
§6 The Replacement of Goods
1.The Buyer also has the right to exchange the purchased Goods for different ones, provided he returns
them in the state not exceeding the normal state of use, unchanged within 14 days from the date of
receipt of the shipment.
2.The return date is the date of shipment.
3.In order to exchange the Goods, the Buyer may use the template form attached to the Rules and
Regulations.
4.In order to exercise the right to exchange the goods, it is important to fill the return form in order for
mydream.pl to send a courier who shall collect the delivery.
5.If possible, the Buyer prepares the Goods in the original packaging, together with a proof of purchase
(in particular: receipt, invoice, account statement).
6.Shipping costs of the replaced item are covered by the Buyer. The Goods should be suitably packed
and secured against any damage during transport.
7.Any differences in the price of the exchanged goods will be compensated via transfer to the bank
account indicated by the Buyer in the exchange form.
§7 Warranty and complaints
1.The Guarantor is Mydream – Michał Ibrom with its registered office at
Banino 80-297, 5/2 Miła Street entered into the register of companies under REGON: 241780008,
NIP: 6482447144, owner of the brand mydream.pl
2.All goods offered by the Guarantor are new and are covered by a guarantee against concealed
defects by fault of the manufacturer.
3.The guarantee is valid only after the original of the proof of purchase has been submitted and is valid
in the territory of the Republic of Poland.
4.The guarantee period is 24 months from the date indicated on the purchase receipt. The period is
renewed if the goods are exchanged
5.The guarantee does not cover: natural wear, mechanical damage, discoloration of the garment,
obvious defects and damage visible on the date of purchase, damage caused by misuse.
6.The buyer is obliged to deliver the returned goods at his own expense along with the filled complaint
form. A template of the complaint form is the Attachment No. 3 to these Rules and Regulations. The
Goods should be returned in the original packaging.
7.The Buyer is obliged to deliver the returned Goods cleaned, without any dirt or hygienic defects,
meaning with compliance to the rules of general hygiene.
8.The Guarantor undertakes to handle the complaint within 14 days of the reception date. If the
complaint is considered to be justified, within the granted guarantee, the Guarantor undertakes, within
21 days of receipt of the complaint, to:
a) first, remove the defect of the goods being the subject of the complaint
b) replace the Goods with a brand new product when the defect is impossible to repair,
c) return the equivalent of the purchased Goods via transfer to the bank account specified by the Buyer
or via cash at the place of purchase, in the case of not being able to remove the defect or exchange it
for a brand new product.
1.In the case when the Guarantor fails to meet the terms set out in the Guarantee Terms, the Buyer
shall have the right to demand a corresponding reduction in the price of the goods or to withdraw from
the Purchase Agreement under the conditions set out in §5 of these Rules and Regulations.
2.The Buyer loses guarantee rights when the Goods were still used after the alleged defect has been
found. The Buyer loses guarantee rights in the event of structural modifications or repairs made on his
own.
3.In order to check the validity of the complaint, the Goods may be given by the Guarantor to an
assessor.
4.In the case when the assessor considers the Buyer’s complaint unreasonable, the Buyer shall cover
the cost of returning the Goods subject to the complaint.
5.In matters not covered by these Rules and Regulations,, the relevant regulations of the Civil Code
apply.
6.The granted guarantee does not exclude, limit or suspend Buyer’s rights as a result of the
incompatibility of the goods with the contract under the regulations of the Civil Code. The Seller shall be
liable for the defect if the defect is discovered within two years of the date of delivery of the item to the
Buyer.
7.A claim for the removal of a defect or replacement of a defective item shall expire with the passing
year from the date on which the defect was discovered. If the Buyer is a Consumer, the expiration
period cannot be completed before the expiry of the period referred to in paragraph 14 above.
8.The Buyer has the possibility to use non-judicial means of handling the complaint and to make claims
resulting from the Agreement with the Seller.
- The case for the Conciliatory Court may be submitted by the Consumer, but also the Buyer, who is
not a Consumer, by submitting a proper application to the appropriate Provincial Inspectorate of Trade
Inspection.
1.The application forms referred to in paragraph 17 above are available on the Provincial Inspectorate
of Trade Inspection websites, the register of which together with the contact details can be found on the
website www.uokik.gov.pl.
2.The Buyer, who is also the Consumer, is also entitled to address the case to the Municipal or District
Consumer Advocate or to seek assistance from the appropriate Consumer Federation. Information on
Consumer Federation can be found at: www.federacja-konsumentow.org.pl
§8 Personal Data Protection
As required by Regulation (EU) 2016/679 of the European
Parliament and of the Council of 27 April 2016 on the protection
of individuals with regard to the processing of personal data
and on the free movement of such data and repealing Directive
95/46 / EC – hereinafter referred to as the RODO – below you will
learn how Mydream processes your personal data:
1.The Administrator of the Buyer’s personal data is the Seller Mydream – Michał Ibrom with its registered office at Banino 80-297, 5/2 Miła Street entered into the
register of companies under REGON: 241780008, NIP: 6482447144,
2.The Data Administrator processes the Buyer’s data only for the purposes of handling the placed
Orders and also, depending on the additional consent, for marketing purposes. Personal data is
processed in accordance with the regulations of the act of 25 May 2018 on the protection of personal
data (Dz.U. [Journal of Laws] from 2016 item 922).
3.Detailed provisions concerning the protection of personal data are specified by the Privacy Policy,
which is an integral part of these Rules and Regulations.
§9 Final provisions
1.These Rules and Regulations are available free of charge in an electronic form via the website of the
store, in a form enabling it to be acquired, reproduced and recorded.
2.The Seller reserves the right to change the provisions of the Rules and Regulations if the necessity to
make changes results directly from the change of the law and to improve the quality of the services
provided. The Buyers shall be informed of changes in the Rules and Regulations by posting information
about the changes at the address: mydream@mydream.pl. Any changes to the Rules and Regulations
shall take effect within 14 days of their publication in the manner described in the preceding sentence.
Orders placed by the Buyers prior to the changes coming into force will be carried out according to the
existing regulations of the Rules and Regulations.
3.Any disputes arising out of the implementation of the regulation in these Rules and Regulations will
be dealt with in first instance by agreement by the parties. In the case of lack of the agreement,
disputes shall be settled by the Conciliatory Court or a court of law, in accordance with the regulations
of the act of 17 November 1963. Code of Civil Procedure (Dz.U. [Journal of laws] from 1964, No. 43,
item 296. as amended).
4.In the cases not regulated by these Rules and Regulations the regulations of the Polish law, in
particular the Civil Code and the Consumer Rights Act are implemented.
